Tennessee e-signature and notarization law

Tennessee's electronic signature law: the Uniform Electronic Transactions Act (2001 Tenn. Pub. Acts ch. 72 (S.B. 376)). Electronic signatures are also valid under the federal ESIGN Act for most transactions. Some documents are excluded, such as wills, divorce and adoption documents, court orders and certain official notices.

The fuller federal list is in our guide to e-signing in the United States.

What Tennessee's e-signature law does not cover

Tennessee enacted the Act as 2001 Public Chapter 72. As enacted, section 3 says it does not apply to:

  • Wills, codicils and testamentary trusts, to the extent a law on their creation and execution governs the transaction.
  • Title 47, Chapters 1 through 9, the Uniform Commercial Code, excepting sections 47-1-107 and 47-1-206 and Chapters 2 and 2A.

These exclusions are described here as the 2001 public chapter enacted them.

Remote online notarization in Tennessee

Remote online notarization: allowed in Tennessee since July 1, 2019.

Tennessee's Online Notary Public Act added a new part 3 to Title 8, Chapter 16. Under it, an online notary public is a commissioned notary who has been additionally commissioned to perform online notarizations.

The Tennessee Secretary of State explains that the notary and the principal are not in the same place but interact remotely over the internet, and that notaries may perform online remote notarizations after completing an application and receiving approval from the Secretary of State.

The Act took effect July 1, 2019, other than for rulemaking.

SignAndGo doesn't notarize documents. A commissioned notary does that, using a remote notarization platform where the state allows it.
