Kentucky e-signature and notarization law

Kentucky's electronic signature law: the Uniform Electronic Transactions Act (KRS 369.101 to 369.120). Electronic signatures are also valid under the federal ESIGN Act for most transactions. Some documents are excluded, such as wills, divorce and adoption documents, court orders and certain official notices.

The fuller federal list is in our guide to e-signing in the United States.

What Kentucky's e-signature law does not cover

KRS 369.103 says the Act does not apply to transactions governed by:

  • A law governing the creation and execution of wills, codicils or testamentary trusts.
  • KRS Chapter 355, the Uniform Commercial Code, other than KRS 355.1-107 and 355.1-206 and Articles 2 and 2A of that chapter.
  • A law governing the creation or transfer of any negotiable instrument, or any instrument establishing title or an interest in title to a motor vehicle.

Kentucky's notary law is tied to this Act too: KRS 423.445 says KRS 423.300 to 423.455 are to be construed and applied consistently with KRS 369.101 to 369.120.

Remote online notarization in Kentucky

Remote online notarization: allowed in Kentucky since January 1, 2020.

KRS 423.455 says a notary public located in Kentucky may perform a notarial act facilitated by communication technology for a remotely located individual. The section was created by 2019 Ky. Acts chapter 86, section 32, effective January 1, 2020.

A commission alone is not enough. Registration under KRS 423.390, and compliance with KRS 423.300 to 423.455, is required before a notary with an existing commission may act as an online notary public.

SignAndGo doesn't notarize documents. A commissioned notary does that, using a remote notarization platform where the state allows it.
