Florida e-signature and notarization law
Florida's electronic signature law: the Uniform Electronic Transaction Act (Fla. Stat. § 668.50). Electronic signatures are also valid under the federal ESIGN Act for most transactions. Some documents are excluded, such as wills, divorce and adoption documents, court orders and certain official notices.
The fuller federal list is in our guide to e-signing in the United States.
What Florida's e-signature law does not cover
Florida's Act is a single section of the statutes, § 668.50. Subsection (3) says it does not apply to a transaction to the extent it is governed by:
- A provision of law governing the creation and execution of wills, codicils or testamentary trusts.
- The Uniform Commercial Code, other than s. 671.107 and chapters 672 and 680.
- The Uniform Computer Information Transactions Act.
- Rules relating to judicial procedure, except with respect to subsections (2), (9) and (11) of the section.
Remote online notarization in Florida
Remote online notarization: allowed in Florida since January 1, 2020.
Florida's online notarization rules are in chapter 117, part II of the Florida Statutes. Under § 117.209, an online notary public may perform any of the functions authorized under part I of the chapter as an online notarization, excluding solemnizing the rites of matrimony.
Florida requires a separate registration. Under § 117.225, a notary completes registration as an online notary public with the Department of State, starting with holding a current commission as a notary public under part I.
Section 117.209 was created by chapter 2019-71, Laws of Florida, which took effect January 1, 2020.
SignAndGo doesn't notarize documents. A commissioned notary does that, using a remote notarization platform where the state allows it.
